Terms and Conditions
PRIMEJobs ("Web Site")(and any other site accessed through this site) and the services provided therein are only available to users seeking employment ("Jobseekers") or users seeking employees or advertisers ("Employers") and are subject to the Terms and Conditions which are set out below. You agree that the use of the Web Site constitutes your acceptance of these terms and conditions which are binding upon you. The Hong Kong Management Association ("the Organization") may revise the Terms and Conditions at anytime by updating this section. You are advised to visit this page periodically to review the Terms and Conditions. Your access to the Organization's Web Site and its services will be terminated upon your notice to the Organization that any change is unacceptable otherwise your continued use will constitute your acceptance of all changes and they will be binding upon you.
1. Web Site Uses
a. Specific User - Jobseeker(s)
Jobseekers agree that they will only use the Organization's Web Site (and any other sites accessed through this site) for lawful purposes and to seek employment. Jobseekers may send their resume directly to any Employer who advertises on or through the Organization's Web Site. However, the Organization will not be responsible or held liable in any way if any Employer, whether in Hong Kong or elsewhere, should use the Jobseeker's personal data for any other use other than for obtaining potential employees. Jobseekers accept that personal data given to Employers or other users are given entirely at their own risk.
b. Specific User - Employer(s)
Upon payment of the Service Fee, if any, to the Organization or upon acceptance of any free trial promotion offer, the Employer will be entitled to use the Organization's Web Site to advertise job vacancies and/or create their own web page on the Organization's Web Site for a predetermined period following agreement of the predetermined service. The only exception is a free trial promotional offer. Employers will be solely responsible for the contents and materials contained in their advertisement and/or web page. The Organization reserves the right to edit any advertisement or web page as it sees fit. The Organization reserves the right to change the policy or institute new charges or fees, as it deems appropriate. In the event that any Employer should fail to pay the Service Fee or any other fees, if any, or changes due to the Organization, the Organization reserves the right to suspend or terminate the Employer's web page or advertisement, without prejudice to all other rights and remedies.
c. Prohibited Uses - Jobseekers and Employers
Jobseekers and Employers agree not to use any of the Organization's Web Site for any of the following purposes which are expressly prohibited:
i. Jobseekers shall not post any non-resume information and/or incomplete, false or inaccurate resume information which is not their own accurate resume.
ii. Jobseekers shall not respond to any employment opportunity for any reason other than to apply for the job advertised and Employers shall not respond to any Jobseeker other than in connection with their application for a job. Communications soliciting business for any reason is prohibited.
iii. All users shall not print, download, duplicate or otherwise copy or use any personally identifiable information about other users. All unsolicited communications of any type to users is strictly prohibited.
iv. All users shall not delete or revise any material posted by any other person or entity.
v. All users are prohibited from violating or attempting to violate the security of the Organization's Web Site (or any other sites accessed through the Organization's Web Site) including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertising of products or services, violations of system or network security may result in civil or criminal liability.
vi. All users will not use the Organization's Web Site in order to transmit, distribute or store material in violation of any applicable law or regulation, or in any manner that will infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or that is libelous, obscene, threatening, abusive or hateful.
2. Copyright, Trademarks etc.
The graphics, images, editorial content and HTMC on all the Organization's Web Site are the intellectual property of the Organization and are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of the Organization. Re-use of any of the foregoing is strictly prohibited and the Organization reserves all rights.
3. Responsibility
i. The Organization may not monitor its Web Site at all times but reserves the right to do so. The Organization takes no responsibility whatsoever for any material input by any user or others and not posted by the Organization. All users acknowledge and agree that they are solely responsible for the form, content and accuracy of any resume, advertisement, web page or material contained therein placed by them. The Organization is not responsible for the content of any other web sites linked to the Organization's Web Site; links are provided as internet navigation tools only. The Organization does not warrant that any resume, advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The Organization is not in anyway to be considered to be an agent with respect to any users of the Organization's Web Site and the Organization will not be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on the Organization's Web Site.
ii. The organization does not warrant that its web site is or will be error-free, that the web site and its server is or will be at any time free of computer viruses or other harmful mechanisms, that any defects will be corrected, or that the operation of the Web Site will be uninterrupted, timely or secure. If your use of the Web Site, the merchandise or the materials results in the need for servicing or replacing equipment or data, by any user, the Organization is not responsible for those costs.
iii. The Organization's Web Site and the contents are provided on an "as is" basis without any warranties of any kind, expressed or implied, to the fullest extent permitted by law.
iv. The Organization disclaims all warranties, whether expressed or implied, including any warranties of merchantability, availability of featured products or services, fitness for particular purpose and non-infringement.
v. The Organization makes no warranties about the accuracy, reliability, completeness or timeliness of the materials, contents or information on the Web Site.
vi. The Organization assumes no liability or responsibility for any errors or omissions in the contents of the Web Site or for the deletion, misdelivery or failure to store any user communications or personalization settings.
vii. All users use the Organization's Web Site and any other web sites accessed through it, at entirely their own risk. ALL users are responsible for their own communications and are responsible for the consequences of their posting. The Organization does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Any reliance by users on material posted by other users will be at their own risk. The Organization reserves the right to expel any user and prevent their further access to the Organization's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal or disruptive.
viii. The Organization's Web Site may contain links to third-party web sites. These are provided solely as a convenience to the user and not in any way as an endorsement by the Organization of the contents on such third-party web sites. If any user accesses any linked third-party web site, they do so entirely at their own risk. The Organization is not responsible for the content of any third-party web site linked to its web site and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites. Further, any materials or details posted in the Organization Web Site by any user may be viewed by users of other web sites linked to the Organization's Web Site and the Organization will not be responsible for any improper use by any user or third party from linked third-party web sites of any data or materials posted on the Organization's Web Site.
ix. In no event shall the Organization, or any third parties mentioned on the Web Site assume responsibility or be liable (to the extent permitted by law) for any damages or injury whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the Web Site, the merchandise and the materials, or any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), theft, destruction or alteration of the Web Site, whether for breach of contract, illegal behaviour, negligence or, under any other cause of action resulting directly or indirectly from any use of the Web Site, or any uploading, downloading or publication of data, text, image or other material or information to or from the Web Site and whether or not the Organization is advised of the possibility of such damages.
4. Indemnity
The organization, its officers, directors, employees or agents shall not be liable in any event for any losses or damages suffered by any user whatsoever arising or resulting from their use or inability to use the Organization's Web Site and its contents.
5. Dealings with Other Users
i. Although the Organization uses its best endeavours to provide an impartial job seeking and recruitment service, and represents a medium supporting information exchanged between the employers and employees, the Organization will not be involved in the dealings between the Job Seeker and the Employer and the Organization will not be responsible for the quality, security and legitimacy of the recruitment service.
ii. The Organization does not warrant or guarantee the accuracy of the information and/or the resume provided by the Job Seeker and of the recruitment advertisements provided by the Employers.
iii. The Organization will not be responsible for whether the Employers will be able to pay the relevant salary or the Job Seeker will be competent to do the job.
iv. Should any dispute arise between the Employers and the Job Seekers, they should resolve this on their own and the Organization will not be responsible for any dispute.
6. Termination
i. If any information provided by the user is inaccurate, in breach of laws or contains indecent elements, the Organization will instantly abrogate the user's account without notice and the Organization reserves the right to take such action as the Organization considers appropriate, desirable or necessary including but not limited to taking legal action against such user.
ii. The Organization reserves the right at all times to immediately terminate or suspend user's account or user's access to the Web Site or the services provided by the Organization without notice where the Organization is of the opinion that the user has breached any of the terms contained in this agreement or to take further action as the Organization considers appropriate, desirable or necessary.
iii. The Organization reserves the final right and absolute discretion to decide whether the user and/or the Job Seekers and/or Employers have breached any terms of this agreement.
7. Governing Law and Jurisdiction
This Agreement and any dispute or matter arising from or incidental to your use of the organization's Web Site shall be governed by the laws of the Hong Kong Special Administrative Region and both you and the Organization submit to the Jurisdiction of the courts of the Hong Kong Special Administrative Region.
